Submission to Queensland’s Review of the operation of the Adoption Act 2009

Last week ALHR made a submission to Queensland’s Review of the operation of the Adoption Act 2009 calling on the Queensland to join Western Australia, Tasmania, the ACT, New South Wales and Victoria in enabling same sex couples to adopt.

ALHR highlighted that the current discrimination against same sex and gender diverse couples breached Article 26 of the International Covenant on Civil and Political Rights, was at odds with Principle 24 of the Yogyakarta Principles and incongruous with Queensland’s Anti-Discrimination Act 1991. ALHR further submitted that the principle of the best interest of the child as set out in the Convention on the Rights of the Child requires that adoption laws do not discriminate between possible adoption placements on the basis of sexuality.

ALHR welcomes the Queensland Government’s willingness to to examine the operation of the Adoption Act 2009 and looks forward to Queensland joining the majority of the States and Territories in allowing same sex adoption.
