ALHR has made a submission to the Attorney General on the Exposure Draft of the Family Law Amendment (Family Violence and Cross-examination of Parties) Bill 2017—Public Consultation on Cross-examination Amendment
Reform of family law is urgent as the human rights of women and children are being routinely infringed and access to justice is a particular problem in this jurisdiction. In ALHR’s view cross-examination generally is inappropriate for disputes involving family violence, and any proposed reforms should adopt a human rights framework toward domestic violence as well as provide, in practice, the necessary protection to victims.
